Posted - 17 April 2009 : 14:14:01 I went Bankrupt on 24th February 2009 and have a car that is only 1yr into a 4yr HP agreement. The OR has advised that they can just take the car back so have made several calls to try to arrange collection, all I get is promises that someone will call me back but no one ever does.
I sent a recorded delivery letter on the 10th March 2009 stating that I am in bankruptcy, that the car is now uninsured and not taxed, and can they contact me to arrange collection, again I have had no response.
My last call to them on Wednesday 15th April ended in a promise that someone would call me back by the end of the day, I am still waiting for that call.
It seems that the HP company are not that concerned what happens to the vehicle, and I dont want to be held liable if something happens to it because the are failing to collect it.
What are my options here?? I was advised b a friend that it is possible to claim ownership and have the balance written off if they are non compliant. Is this possible??

Posted - 17 April 2009 : 14:25:51 Have you mentioned to the OR that you are unable to get the HP company to pick the car up? They may be able to contact them and move things along. By contacting the OR it shows that you are trying to do the right thing and should stop the situation coming back to you if 6 months later the HP company complain that you haven't returned the car.
