Posted - 17 April 2009 : 18:04:37 Just having another look at forms and stuck again, when listing creditors 1) what do I put for date debt was incurred, when I don't know or it was done over a long period of time,2)what do I put that debt was for (worried that their all going to say the same, household items or expenditure)3)do I put that credit cards and catologues are financial institutions.I would be very grateful for any help and would be interested to hear what other people have put.Worried that OR will think I've just frittered all the money away (probably have though cos got nothing to show for it all) |

Posted - 18 April 2009 : 07:40:11 I forgot to mention that if you go to http://www.hmcourts-service.gov.uk/HMCSCourtFinder/FormFinder.do and type in 6.28 for the form there are also Guidance Notes for completing the 6.28 form and it tells you what information should be entered in each section. |

1. For the date incurred put down the date the loan started or that you took out the credit card. You should be able to get this information from the loan agreement or from your 1st CC statement. If you don't have the agreements/CC statements then you can either call the credit company or just put a rough date and mention this to the OR/bankruptcy clerk when you petition.
2. Did you move house, have a big bill for the car/home, go on holiday, get a consolidation loan with a view to paying off the CCs, etc. If not then just put general expenditure. Don't worry about being judged by the OR as he will deal with similar issues every day.
3. CC and catalogues should go in section 4 as creditors. You can list these as financial institutions. Don't worry about making mistakes on the forms as other people on this forum have said that the bankruptcy clerk has just crossed things out on their forms and written the correct information in.
Section 10 is the section for Members of your Household and Dependents so the information regarding your husband and son can go here. |

Posted - 17 April 2009 : 18:25:35 Sorry, more questions, as me husband is unemployed and only getting jsa is he dependent on me and my 17 year old son has another 2 and half years to do at college where do I explain this. |
