Posted - 20 April 2009 : 08:33:27 Hi All, I am new to the forum and have just gone BR and am worried stiff, had a 20 min telephone interview with a case officier who was horrible and made me feel awful about getting into so much debt!! and now a letter has come through the door saying i need a face to face interview in 2 days time!! it came as a complete shock and now i am worrying myself sick about it. Firstly i don't have 12 months worth of bank statements and having only received the letter on Saturday and my interview is Tuesday doubt i will get them in time, also the account was joint with my partner who isn't BR and have transactions and money going in that isn't mine but how can i prove i didn't spend it! and that money that has been credited was for his use??also, i failed my iva which i had been paying for 3 years due to them not allowing me to reduce my payments after having a baby and i am worried that they will stick a BRU on me as my debt was so high (90k) and i have nothing to show for it and as i entered the IVA so long ago i can't remember what all the loans and cards were used for apart from constantly consolodating and getting into more debt but always having the intention of paying it back. I don't think i can bear to be spoken to like dirt again after the first phone call, like everyone on here i was a hard decision to go BR and if i could of avoided it i would of. Can anyone shed any light on the lack of bank statements, the BRU and has anyone had a face to face interview in the London OR office. Very worried.......Thank you! |

Your case sounds just like mine. I really feel for you. I was very ill over a 4 year period having my two kids and was on sick leave and half pay for approx 4 years, so of course debts built up. I too was told that I could get a BRU and my debt is just consumer, living off credit basically. The caseworker was also hostile and aggressive. We consolidated and reconsolidated our debts too which actually increases them but we did not realise this at the time. If we had know about IVAs and the like in the beginning when things were getting out of hand we would have done that sooner and saved ourselves all this stress. I did not realise that after having atelephone interview they could demand a face to face.
The caseworker also told me that she thought I could get a BRU. I did not gamble this money away I used it to feed my family, my clothes and pay bills but this is what the caseworker threatened me with too.
The other thing was she wanted a lot of information about my OH finances even though he is not BK. They want us to show which payments are his and which are mine and when you put your money together with your OH it does not work like that. These people are suppose to be impartial but in my case they were not.
Furthermore, I do not know why they do not just obtain the statements direct from the banks. I sent the caseworker all the statements I could find and explained I did not have them all but caseworker still kept asking me about them. So I said please can you get them direct from the bank as I know you have this power, as I have not kept every single one. One of them was an account I have not used in over a year. Instead of stressing us out this way why not get the information direct from the source? Makes no sense to me.
I also got the impression that the documents I did provided the caseworker had not read or looked at. I sent him one set of statements which clearly states the name of the bank and the account details and he was asking me for the account number, so I pointed I had already sent him all that information in the statement the number should be on the statement. Now if the caseworker had taken the time to read the paperwork he would not have had the need to ask redundant questions. But this caseworker was only interested in trying to find something that was not there.
When I would try to answer the questions as to why I got into this mess the case worker was not interested this person had their own agenda.

firstly I would say that on the face of the information posted I cannot see why a BRU would be necessary. BRU's have nothing to do with the amount of debt and much to do with being frivolous with the funds and living the high life.
I presume you have already submitted your SoA on which the reasons for each spending will be listed.
As far as the joint account is concerned I'm not sure if you are worried that funds will/have been frozen that belong to your partner or if the high number of transactions, many of which were carried out by your partner is what's worrying you.
Do not let this person upset you. You have not had sufficient time to gather the statements and the examiner knows only too well he/she can obtain them directly from the bank. Let the interview take it's course and answer each question as best you can. Take no notice of any criticism as it is not the examiner's place to judge. His/her job is to establish the facts. If it gets out of hand demand to speak to an assistant receiver or at the least a senior examiner.
