Hi
I got into a huge amount of debt almost 3 years ago and after having my offers to pay reduced amounts to the creditors turned down I basically lot track of everything (one debt got sold on to several collection agencies) and basically put it all to the back of my mind with the intent of filing for bankruptcy. I ended up going overseas on a budget back packing trip for a year but ended up staying in Australia. I have never gotten around to finding out how to sort out the bankruptcy problem until now, very almost 3 years later.
I found a company on the internet called myvesta.org.uk who say they can sort out your bankruptcy in the UK whilst I remain in Australia but I have read that it has to be done within 3 years of living in the UK. 3 years will be up in a week.
I have a few questions:
a) What happens if I don't manage to put anything into action within 3 years of leaving the UK?
b) I don't even have details of all of my creditors - their mail would have been returned to sender. Is there a service that can find out who I owe money to?
c) Would I be wise to use the myvesta service?

Hi Shaun,
You should fill in the 'Contact Me' form on Reviva's site and then Paul will give you a call and discuss the options, fees, etc. as it is better to do this one-to-one rather than via the forum. |

Paul, can I use the Lasting Power of Attorney option if I have been away for more than 3 years? Or is my only option now to lodge in person at the High Court?
Do you offer the Lasting Power of Attorney service? If so, what are the fees involved?
I have completely lost contact and track of my creditors. How can I find out who they are? What if they have already filed for my bankruptcy? Also, I have tried to find out information on whether or not an English bankruptcy would affect my life over here in Australia but there is limited information.

To petition from abroad you would either need to come back to the UK and do this in person ( would be done at the High Court) or alternatively you can elect to have representation in the UK.
However for this to happen you will need to have a Lasting Power of Attorney authorised by the Office of the Public Guardian. This takes time and would be impossible to complete in a week. Currently it can take up to 4-5 months to have authorised.
In order to find the right way forward I would recommend you either speak to Myvesta or ourselves who can work through the best options .

Hi,
ReviviaUK who post on this site also do bankruptcy for people living abroad so could also assist in this issue. I would complete the 'Contact Me' form on both the myvesta and RevivaUK (http://www.revivauk.com/) site straight away so they could advise you of you options.
As far as I am aware if you do not file for BR within 3 yrs of leaving the UK then you would need to file in the country that you are resident in i.e. Oz. RevivaUK or Vesta will be able to tell you whether you could complete or petition for BR within a week but this is pretty tight.
What are you basing the date you left the UK on? Is this the date you moved to Oz, the date your Visa started, etc. RevivaUK or Vesta may be able to tell you when the date you left the UK starts from i.e. if you remained on the electoral register for a couple of months after leaving the UK then maybe this could count as the date you left the UK. Either way you should contact both of these companies today. |
