Posted - 05 May 2009 : 17:19:22 I am declaring BR in 2 weeks time. I was issued with a court summons last year from cabot uk but due to incorrect figures and failure by them to produce required paperwork etc I defended the claim and it is still ongoing so as of yet they have not been given a ccj against me. I have to serve my defence 4 days before my BR hearing and then I think there will be a court date decided for a hearing with cabot. What I want to know is as I will be bankrupt before the CCj is issued does this mean it wont be granted and that they will be included along with other debts in the BR? I know that ccjs are included but I am aware that they have plans to issue a charging order against me if they get the ccj and am just hoping that as I will be BR before it is done that they will be too late to get an interim order? Posted - 05 May 2009 : 21:08:19 I believe that once you are BR the CCCJ will be cancelled as the debt will included within the BR.
Have you got your BR appointment date or are you going to the court in 2 weeks? Normally you need to telephone the court and book an appointment.
