Hi all

A bit of advice please. I went BK on 23 Mar 09. Last year I had an RTA and have still suffered with back problems. I am also self employed. I went to my doctors again about my back on 26 Mar 09 and was signed off work for two weeks. I still have an outstanding claim with the other parties insurance company and they have been good enough to pay my wages when I have been off work in the past. However, since I went BK I have had this claim in for a fortnights wages which I am expecting shortly and will be for just under £500. Obviously because I did not work for those weeks I have been unable to pay my partner any money either and she has had to pay certain bills herself. Therefore, If and when I receive this money, will the OR be entitled to any of it? I can not see why they should as this to me is late wages and they do not get any of my earnings at the moment as I do not earn enough so I do not see why they should be entitled to any now. Sorry if it sounds a bit confusing.

I was signed off by the doctor 3 days after I went bankrupt. Therefore, I assume I do not need to declare this to the OR when I get it then.

Hi acm

If the money is for a loss of earnings for a period prior to bankruptcy then the OR would claim this. If it is for a period post bankruptcy, then you may keep it.

personal injury compensation is yours but anything else should be reported to the OR , it may be classed as a windfall
