I been on this forum for about a month amazing how many memeber joins and how many go, a continiuos flow of people going bankrutpt ... can this continue or do you think the goverment will rethink the bankrutcy laws

I hope others contemplating the process will read these posts and realise that there is life after bankruptcy! You are truely inspirational! and hopefully others will read and take this on board
Bankruptcy is meant to give you a clean start, wipe the sheet cleand etc etc...it is not meant to be a blunt object to beat yourelf over the head with!
I am so please you are dealing with this positively, hust keep that thought further down the line when tempted to take out credit!!

Could give you a hug hug your inspirational to all . still on cloud nine and not coming down nor will i ever sign a credit document again livin life to the full with no interest to pay. I feel fairly lucky with my income though not huge more than enough for me to do what i want to do.
never going to be a GWEK Greed will eventually kill. Thats in all aspects of life not just money

I know the feeling on the marriage breakdown, awful to go through but in the end the best thing that could have happened to me!
Yoou've taken the step and sorted things out, take time to relax and enjoy life for a bit without the burden that debt brings, I bet you felt a couple of inches taller when youleft court, once that burden had been removed. I usually advise clients that they will have the best nights sleep in ages following the making of the order, most don't belive me at the time, but many get back intouch to say that I was right, they did have a good nights sleep - without the worry of debt your mind will relax at bedtime, not churn over all your problems

well what a great response thanks malanie. and very intersting. bankrupt from today but do feel something needs to change .. credit crunch will help stop some people getting in a mess . But there will always be the exception, breakdown of marraige and ill health is my misfortune . well breakdown of marraige a god send actually but didnt realise at the time.

Having been in the industry since 1980 I can safely say that there have been many changes over the years but the principle of bankruptcy remains the same its just the administration and penalties that differ. When I first started my role, you were bankrupt for at least 5 years, with no Automatic Dishcarge. Every bankrupt had a meeting of creditors which they had to attend (although not actually go into the room with the creditors, who were in attendance or represented) this is now all done by fax. Bankrupts also had the indignity of having a 'Public Exmanination held in open Court with a District Judge! although smaller debt cases could on the OR's request be not requested a Public Examination, to explain how/why etc. This all changed in 1986 to 3 years bankrupt for a creditors petition and 2 years for a debtors petition (providing debts under £20k) with an Automatic Discharge, and doing away with the need for the Public Examination. The the Enterprise Act in 2000 brough in many changes which are now in place ie 12 months which caused quite a bit of a furore at the time as it was seen by many to be too soft an option and no deterrant from debt!
Sadly there will always be a need for bankruptcy, but thankfully we have progressed away from Debtors prisons which were in place at the end of the 19th Centuary!!
People in debt are now in the fortunate position of the internet, to have access to advice and help on forums such as this, to enable them to make informed decisions. Thank heavan for that! Prior to the internet it was very difficult to get any advice whatsoever as the OR and his staff was not allowed to provide advice, and people outside the OR's didn't have a clue, we regularly had to answer solicitor queries which they they provided the information totheir clients, and worse still charged them!
Gosh after typing all this and thinking back, I am now feeling very old!
