Posted - 20 May 2009 : 14:22:43 Hi All
Went BR this Monday 18th, got a call this morning (10am) from the OR, seemed to go well, only lasted 20-25 minutes. Confirming details, asked me to confirm landlords address so they can get a copy of the tenancy agreement.
Asked how much tax I pay each month, as i was answering her I reminded her it's all on the S.O.A.
She was pleasant, and laughed when I specially asked if she was OR as she did not seem to introduce herself as an OR. So her laughing (friendly way, not a mocking way) and confirming she was my OR went down well with me, showed me the human side to it all.
I asked her if anyone had looked at my I&E and if they had any idea if I would be paying an IPA and she said it needed to be investigated further and then they will let me know.
Anyway, when she asked if I wanted to take her details down now I explained I was at work (actually was about to visit a client) and could she e-mail me.
Received an e-mail at about 11am, with an attachment of an Income Payment Agreement for me to sign and return in 14 days. The amount I have to pay is only the extra tax I will be receiving.
Does that mean that effectively they have agreed my I&E on my S.O.A and decided I don't have a surplus and only to have to forward them my extra income from NT tax code?
To me, if thats the case, thats a Nil IPA and I am delighted? But am I jumping the gun?
The letter she has sent me starts
Income Payments Agreement under Section 310A of the Insolvency Act 1986

Posted - 21 May 2009 : 10:28:19 I telephoned my OR office and they informed me of two things
(a) They are being encouraged to send out specific NT tax code IPA's right away
(b) It's the not your allocated OR who decides on your I&E, it's a seperate "examiner"
Little surprised about point (b).
So despite receiving this e-mail yesterday (below- see highlighted points I put in bold that got me all excited thinking my final IPA had been agreed), it would appear my "real" IPA if I get one has not been decided yet.
"I refer to recent correspondence with the Official Receiver’s office concerning your income and expenditure. On the basis of the information provided, I have prepared an income payment agreement whereby you undertake to pay money to your creditors out of your disposable income. Please find enclosed:-
an income payments agreement form for you to sign and return to this office within 14 days of the date of this letter. Once the signed form has been returned to this office by you, and providing 14 days has elapsed since the date of this letter, the Official Receiver will sign it, thus making it legally enforceable. You will then receive a further copy of the agreement signed by the Official Receiver, together with details of how the payments should be made to the Official Receiver, any collection agents appointed, or a trustee (if one is appointed).
If you are not happy with the terms of the income payments agreement, please notify the Official Receiver in writing within 14 days of the date of this letter of the reasons for your decision and/or to discuss any variation in the terms, or a change in your circumstances. Failure to return the form or contact the Official Receiver may result in an application being made to Court for an income payments order. If such an application is made, you will receive notification of the date of the hearing, together with a copy of the application and the Official Receiver’s report to Court.
Please note that once the Official Receiver has signed the income payments agreement, you may apply to Court to have it varied or stopped. The income payments agreement may also be varied by written agreement between you and the Official Receiver. If at any time during the period of the agreement you wish to change its terms, please contact the Official Receiver in writing stating the reasons for the requested change"

Posted - 21 May 2009 : 09:26:30 Hi
Just had a look at the figures and they seem fine. I would say that there will be no IPA for you.

Posted - 20 May 2009 : 22:15:32 My guess it is your NT IPA but looking at your SOA I doubt you will get one, as I said you are with same OR as me and maybe do a search under my name in the other forum and find my post about IPA which still has not come to a conclusion as yet. As it is early days I think you should sit tight and see if anything else comes in the post. My name in other forum is restofmylife.....
Good Luck

Posted - 20 May 2009 : 17:32:32 It does say "NT tax IPA" so maybe there is another IPA to follow? Thanks, well maybe it's just the first IPA and there is another on it's way soon, but I am confused as one of the emails sent to me today states

Posted - 20 May 2009 : 16:23:17 As you are with same OR as me I am guessing this is your IPA but a bit strange as you still need to get the initial pack to sign. I would suggest you just sign it and send it back keep your fingers crossed and see what else happens
