Posted - 23 May 2009 : 22:23:41 just a couple of Qs. We aren't in an IPA, and not sure if we'll get one or not.
1. If you get an IPA, and its put in place and signed, and then your income goes down leaving you less than £99 DI, does the IPA stop?
2. If you then get discharged in this time, without income going up, do they still ask for I&E for the 3 years?
3. If you dispute the IPA amount, and it isnt in place by discharge date, what happens?

Posted - 24 May 2009 : 19:58:52 I'm hoping I dont get one, have 36 DI after changes in travel costs as well after promotion... however, if they argue it, they could probably push it down (she'd agreed our previous I&E bits, and then I added 5 to clothing, 10 to travel, 5 to meals at work when I got promoted, doing an extra 9 hours each week, so hopefully this will be ok).
Hubbys income will be reduced by 40 pcm when the company recoup payment for his cctv license, so our income will go down then. If that times in time wise, we might have a better chance of not getting an IPA |

Yes, if you have an IPA during the time you are BR then it is enforceable for 36 months and can go up and down at any time during that time.
If you don't have an IPA between the time you are declared BR and discharged then you will never have an IPA. |

or because it was unenforacable at the time of discharge, it then wouldnt be put back in place? |

1. Yes, you need to inform the OR of any change in income and a new I&E will need to be submitted so if you have less than £99 DI the IPA will stop.
2. Normally you will be asked for an I&E if you are discharged early but I am not too sure if you are discharged automatically. I haven't heard of anyone being asked for an I&E once they have been discharged but I suppose it could happen and the OR/RTLU would be within their rights to request an updated I&E.
3. I doubt if you would be discharged before the IPA situation is resolved. The OR has up until the discharge period (normally 12 months) to get the IPA sorted out. You are well within your rights to dispute the IPA but I think you only have about 14 days to dispute it once you receive the IPA documentation from the OR. If you and the OR cannot come to an agreement about the IPA/DI then it goes to the judge and this would be within the 12 month BR period. |
