hoping you can advise me as i am stuck as what to do.both my husband and i are in receipt of disability benefits and can no longer afford our mortgage. our house has been up for sale for 8mths and we have got mortgage arrears of £2000, we have been given a council property and was wondering if we were still able to claim bankrupcy and if so would we be able to claim from the house address that is up for sale as as yet we have not advised everyone of our creditors of our move back to rented accomodation. thankyou

Hi,

Yes, you can still go bankrupt. If there is a shortfall in your property when it is sold, that can be included.

If there is any equity, that would have to be paid across to the OR.
