in last couple of months I have been trying to find more info about BR before I go BR. It has been scary,difficult and complex for me. so I thought to easy my way by closing bank account I don't need, selling think i don't need or worth, and basically making it easy for myself to understand. and Les to worry to forget some thing or talk about. then go BR.
Is that help at all? dose it matter? with your experience, Is there ant thing you can suggest I do to make more easy and Les painful? As I have to go BR within next 4 weeks.
- I have resigned from being director of company(inactive ltd company) I had in my name. and transferred the director title to my girlfriend from company house. she has same address as me. I also had business account for it with my name which I have closed down yesterday,. Now: 1. I know I have to tell them i was director in my BR form(or do i), but will they need my girlfriend detail?or will the ask why?do they trouble her? About bank account, I closed it to easy the process. dose that helps? or i steel have to tel them and they kick my bout for every thing.
- I had a car worth £3000. I sold it last week. so i could pay of a bit of money my girlfriend gave me so i am clean with her. do i have to tell them(about car)? if so how will they react? - with the rest I"v gut small £500 car, will i lose it?
more I read in forum more difficult it gets for me to face this challenge. how can i get some one to one help? how much that cost?

sorry to charge in but you need to get some offline advice. I would suggest you are getting yourself into a mess and this will cause you untold aggravation with the OR afterwards.
You need to declare EVERYTHING Your girlfriend will have a problem regarding the money that you have paid her in preference to other creditors. The OR has the right - and power - to take the money back. You also need to understand the details re the Ltd company, i.e. 1. why the "transfer of directorship" 2. are you planning to be a shadow director etc etc etc

I have posted another question few minuts ago about settling debt with creditor. I don't know where it is yet but would you give me your opinion on that please.

Closing the accounts shouldn't be a problem but you will need to declare it on the BR form. The OR normally requests bank statements from the last 12 months for any accounts so will probably want to see the statements for this account as well. Don't worry if you don't have them as the OR will be able to get these directly from the bank.
I don't have any experience of Ltd companies and what the courts/OR will or won't be interested in so would recommend that you contact one or more of the links in my previous post. It's always best to get several opinions regarding your situation in order to make sure that the BR process is as smooth as possible. |

So with closing the accounts I did not done any help, it wont matter they will find out any way, is that right?
Do you know if they are interested in what has happened in the accounts, like transactions, paid in/out, restaurant car hire, holiday? I just want to prepare myself. thanks again |

I am not too sure how interested the OR will be in contacting your girlfriend as she is now the company director.
You will need to list the bank account that was closed in the SOA in section 5.4 as this asks for any bank accounts that you have held within the last 2 years.
You will also need to tell them about the car as the SOA also asks for any vehicles that have been disposed off in the last 12 months and the OR will want to know what you did with the proceeds. Giving some of the money to pay off your debts with your girlfriend would be seen as favouring a creditor so this may cause you a bit of trouble.
The £500 car should be fine if you need it for travelling to work or other necessary journeys. If not then the OR is permitted to take this as well even though it isn't worth that much.
There are a few companies that will help with the BR process and who you can talk to about your situation.
The following companies post on this board and are highly respected. They offer free advice and will only charge if you want their assistance in completing the BR forms or even accompanying you to court on the day:

You can also get free advice from the CCCS, CAB and National Debtline although they are extremely busy at the moment so it may take a while to get to speak to someone.
