Posted - 09 June 2009 : 17:53:21 Quick question guys.
I officially went br in April.
I had/have a joint a/c with HSBC with my wife.
The account had a small overdraft which was named on the BR petition.
My wife has just received a letter from HSBC informing her of my BR, and that the account has been frozen but is now demanding payment.
My questions are:
As the debt is part of my BR, can HSBC chase my wife for the money as it was a joint account? My wife is solely dependant on me and has no money of her own so could not pay even if she wanted to. Where does this leave her?
Any help gratefully received. :)

She will fill out the statement of means they have requested to show that she cannot pay unless I give her the money, and I have received a letter today telling me I do not need to take any further action!
So it appears to be a catch 22.
We'll see what happens, unless anyone else has had experience of this?

I'm afraid they can chase her for the overdraft, even though it was included. You are both jointly and severally liable for any joint debts.
I really don't know what to suggest if your wife has no way of paying this debt. Is there a family member who could help out?
Hopefully one of the experts will be along to advise further.
