Posted - 23 June 2009 : 15:45:49 myself & my wife have a date of 10th sept 09 for county court for b.r. we are new to this & very worried we also have 4 children to keep away from this too. when is best to stop paying our debts to save for the fee's & also the house will have to go as that's the only way we can pay for fee's & get deposit for rented house. all very worrying. |

Posted - 24 June 2009 : 12:49:43 You can start looking for rented accommodation now if you are stopping paying your mortgage. You need to have something in place before any repossession and you will probably find it easier to find somewhere now before you go BR.

Posted - 24 June 2009 : 00:11:25 thanks guys. the more info the better. we have now canclled direct debuts for creditors,mortgage,secured lolan etc & now pooping it. i have reason to beleive that they cantt reposses until 2 months arrears have passed. hopefully by then come 10th sept for court we will be ok. what im not sure about is that if & when we will have to look for rented house, when & if we can move out before we are br. the car is hp. |

Posted - 23 June 2009 : 23:02:23 Hi I'm no expert but i was given advice from people off here. firstly check your car is def on hp and is not a car loan (ie car is not attached to debt it is more like an unsecured loan). This is the position we were in. If this is the case then the hp company cannot take the car.
the or can take the car if it is worth over 2k, if it is not you need a valid reason for keeping it ie work and no other way to get there.
I would def stop paying creditors as it can't get any worse otherwise you wouldn't be going br |

Posted - 23 June 2009 : 19:19:17 It will take them a while to evict you - I believe you have to miss three months payments before they start to take action. Not 100% on that though.
This is why you need to take this time to sort out some rented accommodation.

Posted - 23 June 2009 : 17:47:01 thats the other problem. should i keep paying that until the courst date i dont know. as we dont want to lose that. would thet get funny if we carried on paying that one only? we have been advised that we may be able to keep it as its only worth £1500 but valuable as we fill it up with kids. |

As regards the car, what is going to happen about the payments?

Stop paying your creditors now so that you can get the fees together. The creditors won't be able to do anything to you at all - after all, what can they do? You will just have to put up with the phone calls and letters I'm afraid.
