I am 17000 pounds in debt in the UK in the form of one overdraft and two credit cards. I have been legally living in the USA for 6 months and intend to stay here permanently.I earn roughly 1800 dollars a month, and after taxes, rent, health insurance, bills etc I don't have much money left at the end of the month, I can not see how I am going to be able to pay off the debt. I have absolutely no assets in the UK (not even clothes!) and only a cheap car in the US to get to work. I am on a temporary visa but will be applying for my green card.

1) Would it affect my green card application if I was to ever declare myself bankrupt in the UK?

2) If I was to file for bankruptcy, would my US bank account be safe, or would they have access to that?

3) My friend has lasting power of attorney in the UK for me...could I use her to present the petition or does it have to be solicitor?

If you are legally in the States, then you will have some form of immigration visa anyway. Either you have employment, or you have family out there.

You wouldn't be able to apply for citizenship until after 5 years (if that is what you wanted to do), so that if you did declare BR then it would all be over and done with by then.

Hi,

1. I'm not too sure about this. What is the criteria for a green card? Is is just a case that you have resided in the US for a certain period and that your job couldn't be filled by a US citizen? If so then your credit problems in another country shouldn't be an issue.

2. You have to declare all open bank accounts on the SOA when petitioning for BR so you should put these details down. I am not sure whether the OR would inform them that you were BR in the UK or not but maybe someone else can advise on this.

3. Yes, use your friend. There is no need for a solicitor to represent you and most people represent themselves but if you don't want to return to the UK to petition then you can use your friend.
