Posted - 29 June 2009 : 14:40:46 Hi, I became bankrupt in early March this year. I now have a IPA set up for the next 36 months, I'm paying £263.00 per month. Up until this month, I received no child maintenance from my ex-husband as the company he worked for went bust. He has now informed me that he has got a new job and will soon be able to return to paying me monthly. I'm aware that I will need to tell OR about my additional income, but are they allowed to take this money from me as it's for my children and not me? I'd be really grateful if someone knew the answer to this! Thanks very much. |

Posted - 30 June 2009 : 18:25:03 I'm not sure, and I hope one of the experts can pick up on this. I'd hate for your kids to suffer as well. It would be nice to be able to afford a few treats for them now and then.

I could completely understand if they wanted to take the rest of my disposable income. I hope that I don't sound really greedy, I just don't want my children to suffer as a result of my bankruptcy. Posted - 29 June 2009 : 17:33:15 I just had a thought , could the maintaince money be payed in to a trust account, then it could be for the children only, May be your parent could be the trustees. I don't know if that will work or not.
