Hi again, have just been reading the post by Cindoboy (i think) and it mentions having money in a bank account. . . if you are slightly in credit are you allowed to keep the a/c open, and continue using it ??!

I was declared BR in March and the nalance on both my CO OP account and Natwest were in creddit by about £10 with no overdraft. The OR said he would write to both and say they had no interest in the accounts. I called Natwest to confirm and they said they did not have a letter when I called a week later. Since then, nearly 4 months on and natwest and co op are still letting me run the accounts and I even have a maestro card with Natwest. They have said nothing and the account is up and running fine. Don't know if that helps you.

They normally write to you and tell you that they will be shutting the account down within 30 days.

With the calls, even if they were veiled threats, there's nothing they can do about it at all.

Just ignore them.

You can't pay them any money and they can't make you.

I'd be interested to hear from anyone who has been made BR in the last few months to see if they have had a change of atitude.

I went BR on the 19th and got calls from the HSBC starting on Friday last, really saying i should not have been made BR and asking questions like did i do all i could to avoid it and had i had advice and i was really worried they were veiled threats, i got another one this morning, the OR said it would be about 8 weeks from the BR date that they would be informed, they never got it from me so they must have indeed trawled the register.
I was panic struck on Friday when they started, asking me for a payment of just over £100 when i was in nearly £1,000 arrears from a loan, but the difinately knew i was BR.
The account is still open by the way.

Hi Jan

I spoke to a customer service advisor the other day and he told me that HSBC are becoming more open to people who are bankrupt, and now look at opening accounts on a case by case basis, so it could be worth a try

It depends on the bank as well - if it is HSBC or First Direct, there is a very good chance that they will close the account. They regularly trawl the insolvency register and close the accounts of those both bankrupt or in an IVA.

That will depend upon the bank. You should give them a call and see if they will let you keep the account open when you have been declared BR.

I think you are only entitled to a basic account when BR so no overdraft, etc. but if the bank is happy for you to keep the account then it should be fine or maybe they will transfer the account to a basic version until you are discharged.
