Ok, this is my first post but have been havin a nose round the site for a loong time,

I have recently become BR and awaiting or interview etc, i was just wandering on a couple o things........

The wife who is not br has just started a new job which is part time and pays around £100 a month into her own a/c - is this something i will need to disclose to or as my wife uses this money to buy extras that we need / treat the kids etc etc

Also im not sure if i will get a bro/bru due to a small recent debt but how do they work??? are you still discharged after a year or effectivly an undischarged bankrupt for the duration of bru/bro and then once bru / bro is complete is it six years from then that the credit score becomes clean? so for example with a 3yr bro effectively the br will be on credit record for 9 years????

Hope it makes sense to someone

Cheers

Hi,

Normally the OR will want to know how much your wife is contributing to the household. The OR can't force your wife to contribute so if you tell the OR that she doesn't contribute anything then they will accept that. You are the one who is BR so the OR has a lot of power over you (i.e. can check your bank statements, wage slips, etc.) but the OR has no power over a partner that isn't BR.

There is more information regarding BRUs at http://www.insolvency.gov.uk/pdfs/guidanceleafletspdf/bro.pdf

With a BRU you are still discharged after 1 year but the bankruptcy restrictions continue until the BRU expires. The Insolvency Register shows that you have a BRU against you and I think (not too sure about this) that you remain on the Register until the BRU expires.

Whether you get a BRU or not will more likely depend upon your overall situation with the small debt i.e. if it is only a small percentage of the overall debt you may be ok. I think this is the way that is works with gambling; if a small percentage of the debt is due to gambling then you may not get a BRU.
