Posted - 14 July 2009 : 22:10:16 OR has released my Hire purchase car from my bankruptcy. I spoke to OR and has allowed me to keep the car, Just received a letter from Hp company to collect the car for the end of the month, I really need a car, I live in a village, a disabled child, who needs transport, would it be possible for the hp company to allow me to carry on my payments as usual and keep the car, if I write to them stating my needs. The hp agreement does have a bankruptcy clause which states they can take the car. If I declined to sign for the release of the vehicle, how long would I have before the court could make me release the car? I am really desperate to keep the car.I have no funds and no equity from the car. Any help would be much appreciated. Dave.

Posted - 15 July 2009 : 00:18:27 Usually it depends on the terms of the contract as to whether they can take it without court action. remember it is their property until the last payment. Worth checking the agreement very carefully
