Hubby and I were made bankrupt on 2nd July, opened a new bank account with coop and changed everything over or so we thought. When I spoke to the child tax credits they told me they would inform child benefit too. My tax credits have gone into the coop but my child benefit has gone into my old account which is overdrawn to the tune of £1000. Child benefit have said they can't recall the payment. Is there anything I can do?
On the other side of the coin, although I had cancelled all my direct debits, on the 6th July my sky bill went out of my old bank account for £60, do you think I should just leave things as they are or speak to the OR about the child benefit. The thing is, we are going to be really short now this month.

Posted - 29 July 2009 : 10:59:18 if the money was paid after the bankruptcy then the bank cannot keep it to balance against an overdraft.
The money can therefore be claimed by the OR and if you ask politely as can demonstrate hardship through your income & expenditure I would expect the OR will write to the bank and ask them to forward the funds to you.
Posted - 29 July 2009 : 10:11:00 Hi I would ring OR and ask for him to allow this money to be paid to you as my OR has no interest in FA as he says that payment is for the family !!
So ring him and explain I'm sure it will be given back to you.
