Last year I put in a claim for the return of my HSBC Bank charges. I owe HSBC money and have just gone Bankrupt. Once my bankruptcy is over and I have been discharged would I be able to have the money if the banks were asked to pay it back or would the bank still have an intitlement to it as I owed them money through my bankruptcy even though I hade been discharged.

Posted - 31 July 2009 : 07:58:53 If you receive the bank charges then OR would take them and use them to pay off your creditors. This would be the same if you received a tax rebate from the time before or during BR. This would happen even if you received the money after your discharge.
If the money was for a time after you have been discharged then you would be able to keep it.
