Posted - 05 August 2009 : 19:30:19 Hello I have come home to a letter from OR to say i have a meeting in 3 weeks to discuss my debts from 2008. I went bankrupt in March and had telephone interview and everything seemed ok. I had a letter last week asking about I&E, which i returned. Anyone ever had this and what does it lead to? Thanks |

It was an IPAQ form I received but the letter with it said they would write to creditos when I sent it back to ask if they had objections to an early discharge. The letter was an EDREV in the top right hand corner. |

I thought that they had to let you know if they were considering a BRU? Does anyone know this? The form i filled in recently was an IPAQ form for I&E but no early discharge forms :-( |

Posted - 06 August 2009 : 18:00:49 Well I have just received a letter to say I may get early discharge and had to send back an I&E form although I am unemployed. So I wonder if they will ask me for another interview.
I would have thought that once they send the letter they have finished all their investigations, otherwise why send it. It would seem a little quick to me for any creditor to get a letter and reply within a week. All seems a little strange. Maybe it is due to your I&E form, have you already got an IPA or are they considering one maybe? |

Posted - 06 August 2009 : 14:58:40 It is what some people do yes, but is what the OR would term 'obtaining credit with no reasonable prospect of repayment'. They will break down your income and outgoings and plot how much you had available to cover your minimum repayments over the year(s). When it goes into negative, where you don't have enough left to cover the payments, they deem any credit obtained after this as obtaining it with no prospect of being able to repay it.
It really only becomes an issue when there are large sums involved or it goes on for a long period of time.
If it is an interview for a BRU it is their chance to get the facts straight, but also your chance to put your point accross and provide any extenuating circumstances that may be in your defence.

Interesting to hear what's happening with you. Like yourself, I went bankrupt in March this year and apart from a few brief telephone interviews with the OR, nothing more has happened, apart from an IPA. You have me worried now, as I have been expecting a possible BRU, but as I haven't heard anything from the OR, I was hoping that this would not now happen. But as you have only now just heard about a further interview with the OR, with the possibility of a BRU, It's got me worried that maybe I will be called for another interview too. I was hoping I was out of the woods, and the thought of having to explain my various debts in detail to the OR fills me with horror.
I hope your interview goes okay anyway and who knows, it may not be anything to do with a BRU.

Posted - 06 August 2009 : 11:52:57 mmmm, but surely that is something that everyone does when in debt. I remember, with horror, going to the cash machine, drawing money out on my credit card and then going into the bank to put it in my account because my thinking was the interest on the credit card was less than I would have to pay in bank charges as the account was so overdrawn. Mad
I also used credit cards to live as all our wages went on repayments, the OR never mentioned anything to me about it

They may be looking at whether you obtained credit when you could not afford to pay it back, ie using credit to pay credit. Were you using credit card cash withdrawals to make payments on your credit at that time, or using credit cards to pay for living costs because all your income was going on credit repayments?

All though it doesnt happen very often if you have completed an I and E Form for Early Discharge a creditor my have argued against it, and that is why they want to see you.

Posted - 05 August 2009 : 19:54:59 Noone mentioned it in my telephone interview. A lot of my debt was accumulated in 2008, but that was because I bought a house in Sept 2007(most expensive month ever!) which needed completely gutting and renovating. I also ended up robbing peter to pay paul as my income decreased steadily over the year (mortgage adviser). Hope not BRU :-( |

Posted - 05 August 2009 : 19:49:49 hi, i wouldn't want to alarm you but it sounds like a second interview with a view to getting a BRO/U. Could be something else but this is the most common reason. Was this mentioned at your first interview. Did you do anything that would warrent a BRO/U (transfer assets, large new debt shortly before BR etc) |
