Posted - 06 August 2009 : 11:09:54 Can I declare myself bankcrupt while living in Thailand. I lost my job in March 2009 & have aprox £18,000 credit card & bank loan debt. Please help. |

Posted - 07 August 2009 : 08:54:34 You cannot declare bankruptcy in any event because you have assets and would need to declare these to the official receiver and these would go towards repaying your uk debts.
I would suggest that you speak to a forum expert because it may be possible to negotiate with the creditors to repay all of the debt with your UK funds.
This would leave you debt free, not bankrupt and be a better result for the creditors that nothing.
in the right circumstances some creditors settle for 25 - 35% of the debt.

Posted - 07 August 2009 : 02:55:58 Thank you Paul. Please advise, if I stop payments on the £18k debt UK credit cards & bank loan what happens to me if I can't delare BR. I have aprox £7k in a Thai bank (needed for my visa purpose otherwise I am not allowed to stay in Thailand). I also have aprox £8k in my UK bank, which I need to tranfer to Thailand, I have a Thai wife & son & need this money to pay my sons school fees & everyday living expence here in Thailand. I have no job, income or benefits from anywhere. I also have no assits in UK or Thailand. Please help as I see no end to my situation. |

Posted - 06 August 2009 : 19:03:47 Hi Unfortunately you have gone past the 3 year time limit so you are now unable to petition for your bankruptcy here in the UK unless you moved nback to the UK

Posted - 06 August 2009 : 15:21:51 Thank you for your advise. If I've been out of UK more than the 3 years can I still file for bankruptcy? I left UK Feb 2006. I have no income while living in Thailand. The only money I have is whats left over from my redundancy payment, which will be gone within the next few months. I have already stopped my debt payments so am able to carry on a little longer. Any help is appricared. Thank you. |

the lasting power of attorney needs to be filled out correctlyt otherwise they will return it to you. The cost of registering is £150.
the court fee will be £522 and you will need to petition at the High Court in London.
There are companies that will represent you for less than the flight back or you could employ a solicitor but a solicitor will charge upwards of £1500 to do all the forms and attend court

If you have lived in the UK during the past three years, then you can declare BR over here. You will either have to come back yourself to do it, or appoint a friend or family member as Power of Attorney and they can present the petition for you.
