Can you please advise me. I have just received a solicitors letter regarding the voluntary repossession of my house (I became bankrupt in February this year). It is an Originating Summons and states the following: By this summons the Plaintiff claims against the defendant under Order 88 of the Rules of the Supreme Court
1. Delivery by the Defendant to the Plaintiff of possession of the premises described in the Second schedule hereto.
2. Further or other relief
3. Costs

If the Defendant does not enter an appearance such judgement maybe given or order made against or in relation to him as the Court may think just and expedient.

What does this mean? I really don't want to go to court to contest this and I haven't found anywhere else to live just yet, so do I have to vacate the premises within the next few weeks and will I have to pay all costs if I am bankrupt?

I am extremely worried about this. Any advice would be greatly appreciated.

Hi

You don't need to go to court unless you are trying to stay there longer.

It sounds as if this is the first court order for possession, they need to have a reposession and finally eviction date.

Time is ticking so I would recommend you move forward with finding somewhere else soon.

Any shortfall from the house will be included in the Br
