Posted - 07 August 2009 : 11:03:06 Have you had your letter of non compliance yet? Once you have that and the fees you can go ahead.
As Mick says, check your IVA to see if you have anything in there about them petitioning for you if there are sufficient funds.
Otherwise, I'd ignore the calls until such time as you have the fees together.

Posted - 07 August 2009 : 11:00:02 I dont really think it matters if you tell them you are going bankrupt or not.
I told one of my creditors and nothing happened whilst i was saving to go BR. I suppose it depends how long ago it was they had any payments before they take any further action.
Some of my creditors had not been paid for 6 months upto us going BR so depending on how long they have not been payed for you will prob just get calls and letters.

PS did you not have anything in your agreement that you would be made BR if your IVA failed
