One of my creditors listed on the SOA is owed £15,000. He is an unconventional lender!! (I have Trading Standards investigating him at present to see if he complies with all the rules that cover his licence)
He said he will put a charge on my property. My wife is in the middle of buying the BI, not completed as yet in process with OR nominated solicitor.
Any advice welcome, Richard |

Thank you for that - I did mention him to the OR at my interview that he was a nasty piece of work (even though he is 82 - he has his "followers").
The local Trading Standards team have interviewed him under caution and will be submitting (this week) a report to the OFT recomending he has his licence taken away.
I will get back to the OR in a short note (as they are busy) and that way it will be on file.

That was my view too - I think he is trying to stress my wife and I. I am not a lawyer, although many many years ago, I studied law as a post graduate student (never went further). What I understand is that as his loan is contained within my SOA and therefore my BR, then he cannot make a fresh claim to have the debt passed over and claim back in another way.
He is a nasty loan shark I am afraid and before my BR, like so many of us, I got hooked in - I was open with the OR at my interview and said make sure he does not "threaten" you... He is that nasty I am afraid!!
As I said I went to Trading Standards and they are investigating him and his tactics - a report is going to the OFT and we hope his "licence to lend" will be removed...
