HELP WITH SOA PLEASE.IN SECTION7 OUTGOINGS,MY LIST OF EXPENDITURES ARE NOT enough IN THE BOXES,WHERE WILL I PUT THE REST?SECTION8 8.2 NAME AND ADDRESS OF ANY JOINT TENANTS.IS THIS MY HOUSEMATES WHERE I SHARE RENT?IN SECTION4 LIST OF SECURED CREDITORS,I AM SURRENDERING MY FINANCE CAR ON MONDAY.I HAVE 3MONTHS BEHIND PAYMENT ON THIS.THE QUESTION IS WHAT OF YOURS IS CLAIMED AND WHAT IS ITS PRESENT VALUE,AND NET AMOUNT OWING?.....BY THE WAY,I AM PETITIONING ON THE 1ST OF SEPTEMBER.

The only thing I can think of is if the car is taken back by the HP company any shortfall would become unsecured and therefore included in BR.

Hi Skippy its just what my OR told me when she went through my expenditure.

I thought the same too, as it is secured against a property. But she was adiment that it wasnt.

I agree with Jane that HP on a car is a secured debt as it is secured on the car.

My OR Told me that a HP agreement is an unsecured debt as its not secured against an asset.

I was told that my car on HP was a secured debt as the debt is secured on the car and if you don't pay, they repossess it, so I put the car in the secured debt section, perhaps an expert will advise???

Hi
There is a box in the outgoings to put a total of any others and then another box to detail them, also put in your reason for bankruptcy section these extra outgoings and the necesity of them

Do you own the property are you the single rent payer, and do they pay you, or do they all pay a percentage if its the later, then you need to put your landlord and each other tenant

With the Car if this is HP then its an unsecured debt, and goes into the unsecured section, you need to ring the finance company and ask for a settlement quote and ask them to put that in writing too, if it is a HP agreement ask them for a voluntary termination of agreement form, fill in your detsils and send both to the OR's office for them to deal with.
