i am married with three children, my wife was born visialy impeared and claims disability care and mobility allowence. i am in process of filling out bankruptcy forms do i have to declair my wifes benefit and does this have to be included in income, also i have a car which was brought for £800 i use it to travel to work also to drive my wife about as she can not drive due to disability being a guide dog owner will my car be sold as an asset?

If your wife contributes to the household bills, food, etc. then you can put this amount down as part of your income:

Your Income - xxxx
Wife's contribution - xxxx

If your wife doesn't contribute then you don't need to put anything down. During the OR's interview you will be asked if your wife contributes. If she doesn't or if she only contributes a small percentage of the outgoings then just tell the OR that she doesn't get much money, has her own bills to pay, etc. The OR has control over your finances but not your wife's.

no it is me that is filing for bankruptcy, was unsure of the position concerning her disability benefit do not want to be accused of fraud if i do not included her money when asked about other people living in house controbuting to household expences all though my wife a dependent as well as the children

Hi,

If your wife is the one declaring BR then you need to include the disability and mobility allowance in her income.

If you need the car the get to and from work then there shouldn't be any reason that the OR will take it from you.
