Today I contacted the court about declaring ourselves BR, the earliest date available was 25th of November, now this is booked do I have to inform the creditors or not? I am worried about possible proceedings against us with having to wait for so long.

Hi Richard, thanks for the reply. Our old number was ex directory so I assumed the new number would be as well, but I will check with BT to make sure, thanks for the tip.

Just seen you have had you phone changed - that is good news - it will stop some of the immediate grief of non stop calls morning noon and night!! (I know how bad it was believe me). Just one thing, did you make sure the number is ex directory? It will not cost anything and will save the debt firms trying to get the number...

Thanks again for your input. I think I will wait for a couple of weeks before I inform them of what is happening. I have had my home phone number changed due to malcious calls and that only happened yesterday, so the only way they can contact me is by post.

I waited about 2 months before declaring BR as well and when my creditors called I told them I had an appointment with a couple of IPs. Most of the creditors asked when the appointments were and I just made up a couple of dates over the next 2 weeks. They made a note of the dates and most of the creditors didn't call back until after these dates. When they called back I said I was going to consider my options and thinking about an IVA. A week or so later I told them that I was declaring BR and then never bothered answering their calls after that.

Some people will say that there isn't any point in speaking to your creditors any more as they only threaten you with BR any way but it's up to you. You can either using delaying tactics as I did or just tell them straight away that you are declaring BR. Some creditors will also get more aggressive and call you more often if they know you are declaring BR as they know that they won't get anything from you once you are BR.

It would probably take longer than 2 months for the creditors to get a CCJ or Attachment of Earnings against set up and very, very few of them (HMRC, Council and AMEX are the exceptions) would take you to court to declare you BR as it costs them so much.

Once again "gettingoutofdebt" thank you for your reply, because of the length of time until my court hearing I think I will let them all know. Do I tell them we have filed for BR or do I word it any other way? Also do I tell them that I have consulted an IP before making this decision? I am sure there will be lots more to come in the the next few weeks, hopefully not too many!

Whether to tell creditors or not is completely up to you. I informed all of mine once I had booked the court and then never bothered answering the phone again. Other people didn't inform theirs so it is really up to you.
