Posted - 16 September 2009 : 17:48:29 I was declared bankrupt in April. At my OR interview I told them about a mobile phone contract which I wanted to be included in the bankruptcy. More than 4 months later I am still getting letters from a debt collection agency threatening to take me to court. They called me a couple of months ago and I gave them my bankruptcy details. I thought that would be the end of it but I got another letter today. So I called them and gave them my bankruptcy details again. They asked me to write to them with my bankruptcy documentation which I refused to do. I am not going to pay for all that photocopying and postage. It occurred to me that I may not have been in arrears with my mobile phone contract when I was declared bankrupt, although I was already in the contract. Can they take me to court?

Posted - 16 September 2009 : 23:12:57 Check the terms and conditions of the mobile phone provider.
For example if you are Br and tell O2 they will automatically cancel the contract and make their claim in the Br.
I would also recommend spending the money for 1 photocopy & a stamp to send a copy of the Br order to the agent to help close the matter. Otherwise they are likely to continue and cause more stress.
