Hi
I just feel so down at the moment , declared myself bankrupt in July , taken all this time to get a little settled . Now been told our ex landlady is taking me and my partner to court damages to the flat .
I moved to parents house in view of buying it buy with what being a discharged bankrupt I dont think i will get a mortgage, and I read to even get a rental flat I will need 6 months in advance. Just feel like it never ends I do suffer from depression and sometimes just cry myself to sleep. Just wondered if others have come out of this and made a life for themselves.

did you move out before the bankruptcy? I would be sorely tempted to speak to the OR and just see whether or not they can do anything... you might find that they can do something towards having the money covered in the BR, and then it doesnt go further. Maybe one of the experts will know more, but I'd ask the OR, it cant do any harm :)

Thank you for your kind words means a lot. I have a very loving fiancé whom is getting me through this.

In regards to the previous flat we had no inventory when we took over the tenancy nor when we left .Apparently she has pictures .

I just know i wont get a mortgage, and will lose the house i am in .

But i have gone through a lot once, so I know I will cope with what may happen

I am sorry that you are feeling so low at the moment. I suffer with depression so i can identify with your feelings. Hang in there and you and your partner will get through - It may seem like a long battle. I have days when all I do is cry - I am 57, married 4 daughters (all adult) 2 grandchildren and one due in December - that is what keeps me sane!

Onyour tenancy, did you have an inventory and did you check out when you left? Do you still have the tenancy? It seems to me that your (landlord) has very little chance of getting anything in court - do not worry.I actually doubt if she will take you to court as the issue fee is £150, she has possession of the property from what you have said so why is she getting out of her pram?

I have 30 years experience of letting properties and you do not need to find 6 months rent - normally a month and a month for deposit.

do you have children? If so, the local council may be able to assist you with the deposit and rent in advance. You would be in one of the priority groups as potentially homeless.

If you do not have children - they may assist you as you are suffering from a mentla health issue (depression). Millions of us suffer 1 in 4 my psychiatrist told me yesterday!! The coulcil may be able to find you somewhare where you do not even need references - they will underright your rent and have it paid direct.

Please come back with some more detail and I will try to "talk" you through the situation

I had 450 arrears in rent , and apparent 327.00 of damage. I left a 550 deposit so I knew the rent was covered. It just horrid some of the things she is claiming .I only got this after i was made bankrupt .
It good to know that some landlords don't do credit checks .

Re: renting.
You might not need 6 months in advance, not all agencies credit check, and most private landlords dont. We're moving (hopefully) in just over a week, with an agency, no credit check and standard deposit/rent.

What on earth damages could you possibly have done that made it worth taking you to court? was a bill to cover damages issued, and given before BR? If so, you *might* have something helpful there, but its just a guess as I'm no expert.
