I live with my wife and two daughters, aged 3 and 8. I was made bankrupt for not paying a council tax bill in 2005. I couldn't afford a solicitor, the receivers got involved and now they've got a possession order to sell my house in 30 days, their fees have accumulated to 30,000 pounds.. please help me. How can i keep my house over an unpaid 900 pound bill?

Hi Tariq

Is the £30,000 what is required to pay all your debts and costs in full? The Trustee may have found other debts that they have included besides the council tax.

Unfortunately the Trustee can seek possession and sale of your property as you have had your one year grace that would have been given as it is your family home.

Is it the hearing for possession in 30 days or for enforcement of the possession?

If you are not able to raise the money to pay off the Bankruptcy debts and costs, you should probably start to look for alternative accommodation. If you have received an order for possession already, take this to the housing department of your council and see if they can house you if there are no alternatives.

This doesn't really stack up. Firstly I cannot believe that the Receiver's fees are now £30,000 especially if you were made bankrupt for £900.

Secondly, if your house is jointly owned with your wife, the Receiver can not sell your property especally as you have children.

Unfortunately, as so often happens when a creditor makes you bankrupt, things begin to unravel and you lose control of your finances. The only thing that I can suggest, based on the information that you disclosed, is that you try and find an Insolvency lawyer who may be prepared to act for you on a no win, no fee basis.
