Posted - 04 October 2009 : 20:36:24 Hello, I would like to ask the forum, I have been made bankrupt and will soon become redundant, would the OR be entitled to claim my redundancy pay, to pay back my creditors? and also my remaining holiday pay? thank you |

Posted - 09 October 2009 : 12:56:23 Hi Thanks for your response. I have not sign any agreement to pay some disposible income back to my creditors. However, I was unaware that those people family etc should have been termed in the same light as the credit companies when declaring bankruptcy. I don't know what to do now. I could share the monies equally between each one I suppose? I will pay back my father whatever the outcome. Thanks

Posted - 07 October 2009 : 18:22:00 The OR would say that you should have included your father, and anyone else you owed money to, as a creditor in the SOA. Paying back one creditor (your father) and not paying others via the OR could cause problems and make you liable to a BRO so I would not mention this debt to the OR. |

the OR will view your redundancy as a windfall and will be entitled to that.
