Posted - 07 October 2009 : 18:48:21 I sent a copy of my BO to Capital One who I would be due to pay next week and today they have sent me a Default Notice. Is this just a normal thing and do I have to do anything? Also I had payment slips arrive from South West Water to pay a monthly amount. I didnt put them down as a creditor as the bill was paid a month ago. I rang them and it seems they have written off what I would owe since the last bill and now want me to pay a minimum amount each month which to be honest is what I was doing previously. I guess this is because the account was in my name and not my husbands. Is this now going to happen with the Gas & Electric I wonder. I wish Co-op would hurry up with my account details and them I can start paying the utilities again.

I didnt actually put any utility bills on the bankruptcy form because I was in credit with them all but it seems S.W.Water have come and read the meter and started me on a new account. Still nothing from the bank so having to use hubbys for this month's wages. Im sure it will all come out in the wash as they say. Thanks again

Posted - 08 October 2009 : 08:18:41 Capital One would probably argue that the law requires them to send you a default notice but I suggest that it is sour grapes. You need not do anything as the debt will be written off in the bankruptcy and any collection action by them has to cease. If they continue to send letters etc, inform the OR. You should not be dealing with your creditors.
If you put utility bills into your bankruptcy, it is quite normal for the companies involved to safeguard future payments one way or another. It is liely that this may happen with your other service providers.
your Cashminder account with the Coop should soon be up and running. Unfortuately, despite all banks supposedly helping bankrupts, the Cooperative is the only bank that you can almost guarantee will open an account for bankrupts. As a result, they are inundated and accounts are taking longer to open. It will happen.
