Posted - 12 October 2009 : 18:06:28 I agree with the others, it's impossible not to know that it was a mistake. Just because it was the bank's mistake doesn't make it right to spend the money. If you go BR the OR will take a very dim view and you will most likely get a BRU.

Posted - 12 October 2009 : 17:29:03 It was the bank's fault - but you also knew that money was not yours and you should have informed the bank straight away so they could take it back.
You wouldn't have been in this mess if you had.

To the OP,
If you declared BR then you wouldn't have to pay it back but you would more than likely be subject to a BRO (Bankruptcy Restrictions Order). This would mean that, although you would be discharged from BR after 12 months, the BR restrictions (not being able to be a Director of a company, being obliged to tell creditors if you wished to borrow more than £500, etc.) could apply for up to 16 yrs.
My advice would be to talk to the bank and try to work out some type of repayment plan before it goes to court and you (possibly) incur the court costs. You could also mention to the bank that if you did end up going to court your only option would be to declare BR.

Posted - 10 October 2009 : 13:09:15 There was one recently in New Zealand where £10 million was paid into an account and they did a runner.
Don't know if they have caught them or not!

Posted - 10 October 2009 : 10:59:54 I am sure there was a story in the news a while ago where this happened to someone, it was a very large amount of money and they spent it and got sent to prison in the end |

You know that money isn't yours, so should sort it out straight way.
I know if there is anything different on my payslip I am straight on to payroll to get it sorted.

As is was clearly an error and was not an oversight ( i.e. a few hundred pounds he was subject to a BRO. His employer also took civil action against him.

Does sound a little fishy to me as well.

Posted - 09 October 2009 : 22:22:20 I agree with Kallis . . it seems the original poster knows this was an error and (in my opinion only) is prepared to go br to avoid paying it back.
This does give genuine people a very bad name. Please re-consider and come to an arrangement with your bank. |
