Whilst I was bankrupt, I took on a job for an individual. he paid me in advance for the work, and since then, the business arrangement has gone sour. Amongst his abusive emails, he mentions that I have committed a criminal offence by taking wags up front and that he is going to report me to the Police. Is that true? I am now discharged, but I can't find anything about it on the net, and since my file has been closed, the insolvency guys seem a bit busy to help me.

I presume this was not PAYE and that the job was taken on as a Self employed/sole trader basis. In these circumstances then the £500 rule does count as taking a deposit for work to be done, did he know that you were bakrupt at the time, how much was it.

Reading between the lines here, I am guessing your ‘employer’ is aggrieved as he believes that you haven’t completed work that his has pay you for in advance to do ? There is nothing under the terms of bankruptcy that says you cannot be paid in advance for employment, many companies pay their staff mid-month 2 weeks behind and 2 week in advance. The only thing I can think is that this person is picking up on is that a Bankrupt cannot obtain credit for more than £500, but I can’t really see ongoing salary could be classed as ‘credit’.

With regards to the police becoming involved; to the best of my knowledge this would be classed as a civil matter and therefore the police would have no interest. The only action he could take would be to take you to the small claim court.
