Dear All,
I've had a letter today that says the following:
Whilst I have accepted that the majority of your claimed expenditure, I should point out that life insurance is considered to be a discretionary item, so would be excluded from the expenditure used in the calculation.
The stated figures for £94 per month for Electric and £84 per month for Gas are well in excess of average household expenditure for these items. I would required documentary evidence to support your claim, the figures should be for current use only - arrears are not to be included (these figures were allowed when I had my OR interview in July so I'm not sure what has changed).
Please help as I am so worried we are going to get an IPA and we really can't afford to pay it. In the last IPOQ I submitted I showed a surplus income of £9 per month. It looks to me as if they are trying to find ways of squeezing and IPA out of us.
As we are both bankrupt, does it mean that we can only have £99 surplus between us or is it £99 each?
I can't believe I've just had this letter. I mean, what was the point of letting us buy our life insurance policies back if they weren't going to allow us to continue paying them? (Our life insurance policies are the only thing we have protecting the mortgage if we died - can they not allow them?)
Thanks for your help in advance. I know some of you know how to quote from the technical manual and would appreciate it if you could assist me.

Also on my new SOA I put down my new income with a deduction for expenses as in my or interview he told me not to worry about expenses. When he gets my wage slip he will see I haven't included expenses and probably frown on it even though I thought I was doing the right thing.

Posted - 15 October 2009 : 07:51:07 OR might scrap the domestic break too, it just depends on the OR, we were told it was not allowed.
Gas/electric: we have high bills, 2 adults and 3 teenagers, we pay about £200 per month for both, we had to send bills in too as we were querying the IPA. |

Posted - 15 October 2009 : 07:29:30 I would send your gas & electric bills in, if that is what you pay you will have the proof & they will have to allow it. Also, life insurance is supposed to be taken out of your disposable income after an IPA. I think they may disallow the mortgage protection too but any IPA you get wouldn't be much based on these figures so I wouldn't worry too much. |
