I am going to apply for bankruptcy at the end of January 2010, I hardly ever have much money left at the end of the month so the only way I am going to be able to do it is to use my whole months salary and then rely on my family to help me through the month until I get paid again. I have advised my creditors that I am going to be applying for BR in January but I am still geting lots of phone calls and letters. What will happen if they take me to court before January?

I was driven mad by creditors when I stopped paying to save for my fees. I stored every number they called me from and then decided as and when I wanted to speak to them. Even though they had my court date they still called.
When they call just be brave and try not to let them get you down.
I missed three payments to each of them and all they have sent is reminders so try not to worry too much - I know this is easier said than done!

Posted - 15 October 2009 : 19:06:18 They won't take you to court. The only thing they can do is to declare you BR and they won't do this as it costs them money.
Now that you have told them you are declaring BR they will want to get any money out of you they can. Stop paying your creditors (except the mortgage if you pay one and want to keep the property) and don't answer the creditor phone calls any more.
