Will my Wife have to go Bankrupt as well?

I had a bankruptcy order made against me at the start of July, however, we are now starting to get demands for my wife to pay the debts which I had declared in my soa.

As I am the sole breadwinner she has no means of paying these debts, particularly as any of my spare income is going into the IPA the OR is setting up.

The accounts are in joint names (council tax etc...) but I am the one who had taken on the responsibilility for paying them up until my business failed.

Hi

I would agree with Kallis unfortunately if the debts are in joint names then you are both liable for them.

It may be that you are able to reach settlement with the creditors by offering a smaller amount as full and final settelment or reduced monthly payments.

But it may also be best for your wife to declare herself bankrupt therefore removing the debts.

Hi,

I'm afraid that as the debts are joint, even though they have been included in your bankruptcy, she will be chased for the whole amount as you are both jointly and severally liable for them.

If she is not able to come to any arrangement to pay them because of lack of income, it may be that bankruptcy would be the best idea for her as well.
