Posted - 24 October 2009 : 09:57:50 Court date finally here Monday at 9.00 a.m. Husband and myself both declaring bankrupt (I had no choice or I would have been responsible soley for the joint debts. What can we expect to happen? Also because it is both of us do we have an interview with the OR at the same time? Will this also be on Monday or at a later date? Just be glad when it's all over so we can get on with our lives such as it is. Thank you so much Katie |

Posted - 24 October 2009 : 11:10:00 Both hubby and I went bankrupt together, we did not see the judge, just had our forms checked, paid the fees, swore the oath and then had to wait around for a couple of hours and then received our stamped bankruptcy orders from the clerk. We then had to both go into a private room with a telephone and got a call from the OR's office just confirming our details and told that a telephone interview would be sent out to us in the post.
We then had the telephone interview together one week later, I went first and as most of our debts were joint, hubby was only on the phone a few minutes as I had already gone through it all with the OR.

It is stressful and nobody will deny that, but believe me everyone involved in the BR process will treat you well, from the clerk at the court, to the Judge, to the OR - they will assist you through the process.

You will probably not even go in the court. Your papers will be checked, the fees paid and then they will stamped by the judge.
You will probably have an initial call with the OR once you have been declared BR. They will then sort out a time for an appointment, but I don't know if you are interviewed seperately or together.
