Posted - 28 October 2009 : 16:24:00 have been bankrupt for 5weeks and have just had to buy back our car for £150 which was paid by family as or did not believe was essentual even though i use it for transport to work and to ferry my disable wife and three children about in for shopping and hospital appointments etc, have today recieved a letter about my disposable income and a ipa they state i have £66 di per month this has taken into account the overtime i had to include in my statement of affairs, two weeks ago my firm have banned all overtime for the forseable future i have lost about £300 a month with the high posibility of loosing more as my hours are under review to be cut from november,my income is made up of my wages childtax credit and child bennifit i have had to budget my out goings accordingly this has left about £50 di. I thought if di was under £100 it was not taken in an ipa, please can someone advise me on what to do i have to write to the or in 14days i am as stressed as i was before the bankruptcy probley more |

Posted - 28 October 2009 : 22:13:58 Once this has been sorted out you will find it a relief.
When I first went BR it felt like a weight was lifted off my shoulders, and then I had the OR interview and I kept wondering if I'd done the right thing.
Speak to the OR and ask them to explain how they've come to this decision and don't sign anything that you aren't happy with.

Posted - 28 October 2009 : 20:35:38 will need to ask or to clarify the figures as its a sperate iva in addion to the iva for the other, working out my own outgoings against the guidelines given i cannot understand why ive been asked to pay money i do not have to my creditors as my outgoings are less than the guideline allow, its very hard not to take it personaly afer 3years of trying to pay our creditors back before finally addmitting defeat then going through an iva agreement with debtfree direct when electric and gas etc went up with an increasing food bill that failled my wife and i made the very hard decission of applying for bankruptcy as we could in no way afford to pay back anymore now we are still been bled dry, thank you for your input i understand bankruptcy is a huge relief to many people i truely hope there is a time when i can feel that way too |

Posted - 28 October 2009 : 18:28:18 Are you sure this is an IPA and not a NT IPA? When you get an NT (i.e. Nil) Tax Code you will receive an IPA form so this may just be the tax that you are currently paying.
In any case you should contact the OR and ask for clarification about this. If it is an NT IPA then there is no problem. If it is an actual IPA then ask the OR to clarify the figures.
The guideline figures for a household with 2 adults/2 kids is £504 for housekeeping and £156 for clothes so with an extra child you could claim more for clothes than you currently do.
Try not to get too disillusioned, just call the OR and calmly ask whether this is an IPA or a NT IPA and then take it from there. |

You are well within your rights to phone or email the OR to ask for a breakdown of the expenses he has allowed/disallowed. You can then seek advice on them, making sure you have claimed all the expenses you are allowed, and contest them if you don't agree. We did this and came to an agreement with out OR.
Hope that helps a little and try not to worry-it will all sort itself out.
