Hi, I hope this gets on forum I thought I had posted a question earlier but I cannot find it anywhere??

My husband and I started an IVA in October 2007. October 2008 our payments went up nearly £100 even thought our income had not gone up? In November 2008 we were advised by a so called company, we were missold and as we rent and have no assets it would be better for us to go BR. So after a long talk to get our heads around BR we agreed it would be better for us. The company sent us the paperwork and told us to stop IVA payment and to make payments to them to fill in forms and help us through the BR process. After our last payment we heard nothing from this company and after many many calls to there offices were told they had stopped trading and our money was gone. (Stupid I know, I have kicked myself everyday since) We had missed 6 payments to our IVA but when we called to ask them for our termination notice so we could do it ourselves, they said their system did not show we had failed?????? and said we could go back into our IVA no problem they would set up the S/O again and it would be ok as they understood we had been stung.
3 months later we are asked to put in wrtting why we missed payments and this would be sent to our creditors at a creditors meeting that they had set up as we had failed our IVA? and that our payments would go up to cover the missed payments.??(which we cannot afford)
We have decided to do it ourselves but need advise on how to get Termination Notice????? and as they said we had failed our IVA and creditors have not yet agreed for us to return, should this not be sent through anyway? I have informed them in writing that we do not want to return to IVA.
Please can someone help me I want to get this moving I have been trying for nearly a year to start BR process.

Did you do an IP name search.

Declan from DFD posts on the site regularly, and you will Im sure get a response.

Hard Up welcome to the forum.

For a start please do not accept unsolicited offers to arrange BR - all the do is get your details from the Insolvency register, and fleece you for hundreds to do absolutely nothing that you can do yourself.

Which company is your IVA with?

I would put it in writing (Recorded Delivery), stating the facts, and that you require a Termination Certificate forthwith. Speak/email your IP get their details here:

Explain the situation, and be firm. Speak with one of the experts who post on this forum, and get their opinion on moving forward.

BUT DO NOT PART WITH ANY MORE MONEY TO GO BR.
