I live in a rented flat. If I declare bankruptcy could I be forced to move into cheaper accommodation?

I am too young to wear specs as yet!! (True, at 57 I do not need specs!!) I had my eyes tested in October and I read to the bottom line - one mistake!! (I would do better not to mistype though at times...

I think you read my post incorrectly. I am bankrupt and have an IPA, not an IVA. Cor blimey, I think one of those things is enough, don't you? lol

So sorry to hear about your state of health - I hope that you soon get better and that you have a good, kind and understanding G.P. - many of us are suffering in the same way - it is awful and there are good days and bad!!

I wish you well - I would not worry about the flat at the moment - if it becomes an issue or you simply want to share your circumstance, post agai and someone will assist - I look at this site every day

Thanks all.

It's a privately rented flat. I'm going through a bout of depression and am off work on long term sick which is why I'm having to consider bankruptcy. My flat is one of the few things in my life that feels right at the moment so I'm worried about losing it and what that would do to my head.

think Richard and Xmas baby have covered the points for you

do a bit of research on Rightmove for comparable rents.

you may have to justify with OR why you need an XY roomed house in a certain area of town.. yes it might be cheaper to rent a three bed house ten miles away from work and schools but the cost of getting to work and school could negate any saving.

Claire can i hijack your topic to ask xmas baby how she managed to obtain both IVA and BR.. not knocking or challenging just not understanding. thought BR took all debts.. if personal do not reply i understand

Hi Claire99,

I declared BK in March this year and I am renting from a private landlord. I share with my partner and the rent is £530 pm, so my share is £265 pm. The OR didn't mention about getting cheaper accommodation, although I don't think we could get much cheaper. As it is we live on a dodgy council estate and we are even looking at moving to a better place in the next few months, so my rent is likely to increase if anything. I'm sure the OR will love that. I also pay an IPA of £241 pm. I did inform the landlord once I became bankrupt as I am sure the OR would have contacted him anyway and he was fine with it. So long as he is getting the rent paid on time I don't suppose he cares. I wasn't in arrears with my rent, so he had no reason to worry.

I have been phoning around some letting agents and apart from one, who didn't even want to know once I told them I was bankrupt, the others seem to insist on either a guarantor or 6 months deposit. ^ months... are they crazy? Oh yes, I've got £5000 stashed away, thats why I'm bankrupt. Crazy idiots! I'm probably more secure financially than those people who have tons of credit cards, but they would pass the credit check. It makes no sense at all. Being bankrupt may not longer have the social stigma attached to it but when it comes to businesses, they treat you like a leper and would prefer not to touch you with a barge pole.

Hi Claire

Not necessarily - depends on a number of factors.

Are you a council or housing association tenant or in the private sector?

Do you have any rent arrears?

Is the property too big for your family needs?

Let us have some more detail and we will try to offer some suggestions, Regards, Richard
