We are in a leasehold pub, and going bankrupt on Monday, and we have nowhere to live and do not know who will a bankrupt person find rented accommodation. We are in Dorset

Hi again,

Having read the post from debtinfo, I do suggest that to avoid being homeless on Monday - call the out of hours number for the Council and see if they will assist you on Monday with (a) an appointment to see the duty officer and (b) to arrange emergency accommodation (if you have young children of school age) or any health problems that are likely to make you "vulnerable". There are 5 priority categories and the two I have mentioned are the ones you may meet.

Welcome to the forum and I am so sorry to learn of your plight.

As has already been said, most estate/letting agents seek credit checks - we used to, but if someone was upfront, we would waive them.

Most landlords who manage their own properties, do not do credit checks.

You are likely to have to pay one month in advance, plus one month as a deposit (refundable less any delapidations at the end of the tenancy)

If you have children call the councils emergency homelessness number - there will be one available out of hours - or go in first thing Monday morning

I agree with Paul on the separate entrance to your living accommodation

Similarly, you cannot be the licencee post the declaration of your BR. (one point are you both going BR and are you both the licencees?) May be a loophole there - a SLIM chance, but worthy of some planning

I wish you well - I am afraid the pub trade and estate agents have borne the brunt in this blasted recession - Thank you Mr Brown!

Hi Gerard

is there a specific reason that you are petitioning for Br on Monday?

without knowing all the facts I may be speaking out of turn, however from the many many publicans that we have worked with ( mostly with Punch or Enterprise ) it is far better to sort everything out first.

Questions yuou may want to reflect on

1. Does your accomodation have a separate enterance to the pub? if not it may be that you are asked to leave on Monday afternoon.

2. Your personal licence will not be valid on Monday and therefore you cannot be the landlord.

3. It is 100% likely that the Official Receiver will visit the pub VERY SOON ( I mean a fe hours ) after your petition to close the business.

4. You haven't got alternative accomodation and AFTER bankruptcy are highly likely to require several months rent upfront.

5. if you have the cash available now then this MUST be declared to the Official Receiver on the court documents ( STatement of Affairs ) and they will require you to hand over the money.

6. Have you jot alternative employment sorted nout

7. Have you sorted out alternative banking etc etc.

The folks we advise who are in the pub business will always have alternative accomodation sorted out and "prepaid", banking is critical so that benefits etc are protected.

Just my thoughts but without more information it seems like you are rushing without any control of the outcome.

hi and welcome to the forum
letting agent squite often do a credit check but private landlords quite often do not.
Renting privately is your best bet.
