Hi! My father went BR back in 1996, and, at the time, was freeholder of 2 properties, owing about £20k on each property to a solicitors mortgage. These properties have remained let out constantly since then, and he name is still on the Land Reg title. My questions are a) does the Statute of Lim Act Apply, and therefore he can remove the BR charges against the properties as it has been over 12years and b)surely if the solicitor has been receiving c£500 month each month for both properties, there can no longer be any outstanding mortgage.
I apprciate any help with this big muddle!!

thanks for yr responses chaps. Slightly naive question, does the OR apply interest to the initial debt? It was originally c£90k 13 years ago, so thats a lot of interest to go on top! Thanks again in advance

Although what happens if the bankruptcy & costs get paid back in full I wonder???

As they are investment properties the OR will retain the legal title (if they were solely owned)forever or until they are sold. He really needs to get in touch with the OR

I think a charge can remain for any length of time.
