I have an old desktop computer will this be taken away and an old car worth about nine hundred which i need to go shopping with and to pick up my grandson who i look after every weekend

Hi Margaret.

My husband and I went bankrupt in July this year. My husband works and used the car every now and then for work. The OR wanted to take the car as public transport could be used for my husband to get to work. I said that I needed the car as we live in a small town and I have 4 children. 2 from my first marriage whose dad we meet every 2 weeks so the boys get to see their dad. This is a 460 mile round trip and just not possible in a weekend to travel this far and back. The OR denied us keeping the car so we took it to court, which was thrown out due to the exemption not coming under corrent category or somthing - some law jargon. So we had to find a 3rd party to pay for us to keep the car. Our car was only worth £1500 and I had to £750 to keep it.

Margaret welcome,

Your laptop is safe as it is of relatively low value.

The car is as Chester and Kallis 3 have said. An example;-

I had a car - it was worth c £10K - it was sold on behalf of the OR by an auctioneer by tender, the auctoneer takes commission and settles with the OR.

In my case as I would need a car (if I was at work)I was allowed to buy a car with the authority of the OR to the value of £2K - I was able to select the car - inform the auctioneer and give him the invoice - I collected the cheque and the car.

I have to say I feel very humble about this - but delighted - I hope that I do find work soon - am working as a trainee in a volunteer capacity at the moment for the CAB - very rewarding

Your car is worth less than the £2K so, provided you can convince the OR that you need the vehicle, you should be OK. For exam0ple are you suffering from any mobility problems? Is there a lack of public transport etc

it is your responsibilty to satisfy the OR that you should keep the car
if you are working or looking for work it should be no problem
if not ...unless you live in the middle of nowhere it may be difficult to prove the need to keep the car

Hi,

The computer will be safe.

Hopefully the car will be, but I think you will have to justify that you need it to the OR. I don't know if shopping and picking up your grandson would qualify but one of the experts should be able to help further.
