Hi, my sisters son in law is a serving police officer. Is it true he is not allowed to stay in the police if he goes bankrupt. If it is relevant, the guy is still in his probation period. If he were sacked due to this then would it not be classed as discrimination? |

However, I think it varies from force to force, so a quick check is always to be advised.

Hi all,
Sorry this reply a little late, been off line a bit.
I am a serving police officer and went BR on 12/10/09, I had 8 months of stress trying to juggle everything then finally, with help from here went for the BR and made the step to tell my force, they were brilliant, very supportive and have even retained a vetted post given my debt was 'domestic hardship' rather than gambling etc. I was advised that it much more risky to have unmanaged debt than go BR. Definitely the way forward is to speak confidentially with welfare,

Plus you would probably not be able to apply for any specialist positions.
Personally, I would anonymously phone HR to see what that particular force's stance is.

A serving Police Officer in debt is best advised to speak with his Welfare Officer - there is nothing to stop a serving officer from declaring themselves bankrupt, but have to inform their Commanding Officer under 'Standing Order's Reguations - The welfare officer can assist officer's in this, and also provide help and assistance as to other debt solutions out there.
As your relative is on probation he would need to complete his probation period before filing for bankruptcy or run the risk of not having 'completed his probations satisfactorily' which may result in dismissal. Serving officers (having completed their probation) are under no job threat following bankruptcy and have not done so since the late 80's, though some forces will place a 'bar' on promotion for 2 years following bankruptcy.

The force I work for are pretty supportive of existing staff as they sent an email round when the credit crunch struck advising both police officer and police staff to seek advice from the likes of CCCS and Payplan.
Hopefully other forces will be the same.

i forgot to add that police officers can be dismissed for failure to discharge a lawful debt. bankruptcy is seen as an acceptable way to discharge debt. if it helps the male in question would be better waiting til he is out of his probation and trying a DMP or similar until then.

if you are a serving officer out of probation there is no issue in any force. However, if he is still in probation it may be different as they may question his honesty in his application under the part where they asked him about his financial situation.
either way he needs to speak to his welfare officer as if he has unmanagable debts he needs to be open and honest. |

it does depend on which police force.. i know Paul Johns from RevivaUK has had dealings with Police Officers who have gone through BR it may be worthwhile having a free chat with him

Whether or not it's discrimination would surely depend on the terms of the contract. If it states that he cannot stay in his position if he becomes BR then it's not discrimination.
I'd follow Jan's advice as not all forces have the same rules.

I'm not sure what the position is with a serving police officer. I know you're not allowed to join whilst an undischarged bankrupt.
Perhaps he could check up on the rules and regulations on the force intranet or make an anonymous call to HR to see what the position is.
