I was declared Bankrupt in July this year. I have a mortgage on a property with Northern Rock. Before I declared myself Bankrupt I and my family moved into private accomodation and advised NR that I wanted to voluntary surrender the property. They ignored my request and now I have a court order on my doorstep relating to possesion of the property. My question is - Do i have to attend the hearing? Do I have to fill out the deffence if I am not contesting the possesion?
Any help would be greatly recieved.

Posted - 01 December 2009 : 11:16:21 if you are not contesting it i personally would write a small letter saying you have no interest in the property anymore and not bother with the forms, it may make things go a little smoother on the day in court

Posted - 01 December 2009 : 11:08:12 Hi and welcome to the forum you do not need to attend the court unless you are contesting the posession order that they are trying to get NR are just one of the many banks that will do this unless you sign a form stating you are giving them the house back and will accept the shortfall of the mortgage which you are advised NOT to sign
