Hi All,

Just a quick question, my creditors are starting to contact me for payments that are due, I want to tell them I'm going BR on the 22nd December, but I'm worried that the creditors will suddenly get the bailiffs around before the BR happens. How likely is that?

Thank you for any advice.

The best advice is to just state I have a bankruptcy hearing on....at.....County Court. This will stop the creditors taking any action against you and can also reduce the numbers of calls etc that you receive

I told mine 1 month before declaring BR and then never answered the phone again. You aren't obliged to keep your creditors up to speed on your plans but it is normally recommended.

Once you tell them you are declaring BR they WILL step up the pressure as they realise their money will be lost but it doesn't mean you have to speak to them.

Hi Trog,

As Richard said just tell them. I told all mine and I still had about 6 weeks before I went BR.

Some of them were really rude but just be brave (I'm sure you are!!!) they wont have time to do anything.

It is such a relief once its done and the calls stop.

Not long to go now. Good luck, it will all be fine.

Hi Trog,

Do not worry.

The law will protect you - to enable a court bailiff to take action first of all requires your creditor to have taken action against you (normally in the county court) - and to have a judgement against you - some creditors (local authorities for example) can take action in the magistrates court for council tax etc. However, to enter your property they require a warrant of execution. No warrant, then do not let them in!

Tell your creditors that you are petitioning for BR and that they are to be included in your BR petition.

You only have a week or just a bit more hang in there - do not be intimidated by their threats - they are very shallow and often attempt to act against your legal rights. Have a look on the National Debtline website or the CAB website - they will confirm your rights.

When I went BR, I changed my landline - free to do and ensure you go ex directory, if you are not already so - that takes about a week - 10 days normally.

If you have a contract mobile phone - change to a pay as you go - you may be including your contract phone as a creditor in your BR anyway!!

Be strong and after the petition, it is a breath of freedom and although still with some stresses and strains - to be debt free is a good way to be....
