Posted - 10 December 2009 : 08:57:13 I am in bankruptcy a chapter 13.My attorney has me paying my arears to my morgage,my loan,truck payment,business ,and personal bills which are over wellming.He has not got my paments lowered and he is only increasing them.What can i do to get a balanced budget before it is to late. My attorney doasent return my phone calls and the trusstee will not eather.Also I thought that the interest was to stop during bankruptcy is that on unsecured or secured debt.Is there any other financial help or assistance during this.My attorney is poor at advicing me on what could happen.The hearing is scedaled for Jan. 6 2010.I really do not think he has thought my budget through and it is going to get me in touble.Can he get me a modifaction through the courtsfor my home loan. |

Posted - 10 December 2009 : 11:08:07 Hi, as chapter 13 relates to US bankruptcy unfortunately we wouldn't be able to help you on this forum. You'd be better off finding a US forum so that you can get accurate advice.

Am I right in thinking that a chapter 13 is an american bankruptcy scheme, When someone files for bankruptcy under Chapter 13 of the Bankruptcy Code, their aim is to have the opportunity to repay some or all the debts in their name, in better terms, i.e. lower or no interest. . Filing Chapter 13 Bankruptcy is thus applicable for a debtor who has a regular income, and thus can afford to request for such adjustments or reductions.
The regulations state affordable, lower or No interest.
can i suggest find a new lawyer, although you are welome to post on the Uk site and join all of us but you may find other answers on a US based website and perhaps others that are suffering similar problems... having read that back it reads awfully rude, my support for your situation is high but just trying to driect you for best answer
