Hi, i declared myself bankrupt on 23rd october. I advised my credit card and bank accounts of this when they called me asking where there payments were i provided them with my bankruptcy number and all details of court and official reciver however they just will not leave me alone the constantly keep calling even though they know im bankrupt asking me more questions and wanting to know if im going to make any payments as they havent heard from the official reciever yet as for some reason it seems to be taking them so long to tell all my creditors that im bankrupt. i just wondered is it normal for them to keep harrasing me and issuing me with default letters etc even though i am bankrupt and i have told them several times? Also how long should it take for the official reciever to contact them as it seems to be taking what feels like forever. Are they still supposed to be contacting me even though im bankrupt as im really confused why they keep pressing me for a payment each time they call and sending me so many letters when they know im bankrupt and wont be paying anything.

I had problems with Littlewoods hassling me, so I sent them a copy of my BR order and I never heard from them again. It was definitely worth the price of a stamp!

As the others have said, the OR's offices are very busy at the moment so I think you might have to send the order to your creditors yourself.

Good luck x

Hi james the OR will usually send a report to all creditors within 8 weeks, they must send it within 12 weeks. If the creditors do not believe you offer to send them a copy of the bankruptcy order. This is the proof that you are in bankruptcy sealed by the court and so they have no place to argue whether they have been informed by the OR or not

hello James,

I am not an insolvency expert, but I will comment and hope that others more knowledgeable than me on this subject will assist with your situation.

Got to get matters into perspective. The OR is busier than they have ever been in history, so I imagine they are taking a bit longer with their administration.

You have told the creditors that have made contact that you are BR, you have given them your details, i.e. court and reference number. That should be sufficient to stop them.

If they continue to harrass you, say that you will make a formal complaint and refer them to the FSA and to the ombudsman - that may make them sit up!

You could mention it to the ORs office to flag it up, but for the time being, given the volume of BRs nationally, you may wish to wait a while longer - you do not want to alienate the OR!!

You could change your landline - that can be done swiftly and free - make sure you go ex directory - that will keep some of the wolves away.

If you only have a mobile and it is a contract - that may be in your BR so get a "pay as you go" phone and tell your friends and family (I admist that is not a free option)

I was made BR in May this year. In that 7 months, the volume of BR cases has escallated so fast - my creditors had letters within weeks - I am aware that will not necessarily the case now.

The creditors should not be contacting you if they know you are BR - tell them that - be firm. Equally as important, you should not be making any payments to them (I assume that you are not anyway - but sometimes the pressure from these parasites is so immense!)

I do get the odd letter from creditors when they have sold on the debt usually - I tend to ignore that or if it looks important pass to the OR with a note and retain a copy.

I think my simple advice is to stick with it - try not to stress and look forward to a debt free 2010 when you are discharged.

I am sure others wil come to your assistance with some useful coments.

Good luck, Richard
